Terms and Conditions for Holiday Rentals
For the purpose of these terms and conditions, Soane Properties SL with David Moore and Stephen Moore, operating through the website askspain.org, will hereafter be collectively referred to as the “Company”.  The Owner of the rental property will be known as the “Owner”.  The rental client will be known as the “Client”.
  1. Property Rentals.  Advertised prices are listed in euros on a per night basis.  Some property prices may be subject to variation depending on the season and/or the length of stay.  Wherever possible this will be indicated in the property description advertised.
  2. The Contract: A contract does not exist between the Owner and the Client and no booking is agreed (the Owner/Company shall have no obligations to the client) until the Company has accepted and confirmed receipt of the deposit, and the terms and conditions of booking have been accepted by the Client . The Owner/Company have the right to refuse to accept any bookings at the Owner/Company`s discretion, refunding any deposit received if a booking is refused.
  3. Deposit: A deposit of 20% of the total holiday cost will be required to be paid by the Client to the Company, who accepts this on behalf of the Owner, at the time of booking.  At least six weeks prior to arrival date, the residual 80% balance will be required to be paid by the Client to the Company, which is acting on behalf of the Owner. Should the client make the booking within six weeks of traveling, the total must be paid to the Company at the time of booking. The Company accepting this money on behalf of the Owner.
  4. Damage to or Theft from the Property: Credit card details must be given by the lead booker in case of theft from or damage to the property, and then the cost involved will be paid direct from the Client to the Owner. The property will be checked prior to and following occupancy by the Client when any damage to the property will be recorded along with any missing contents.  A written record of damage or missing items will be supplied by the Company to both Owner and Client.
  5. Number of Clients: Where the property is advertised sleeping a certain number of people (usually either four or six) it is not acceptable for more than this number of people to occupy the property, due to overcrowding.   If an extra bed is required, this must be stated at time of booking. Where a property has a sofa bed in the lounge or living area, this will be included in the details of the property.
  6. Pets: Pets are not allowed without having received previous written permission.
  7. Smoking.: Some properties are non-smoking, others allow smoking on terraces, others allow smoking anywhere within the property.   Please check when booking.
  8. Change of Property: When a booking is made for a specific property, with the photographs on the website, that booking will be confirmed for that specific property.  Should there be a need to change the booking to a different property the Company reserves the right to do so, first informing the Client. Any alternative accommodation to be offered will be as close in style and location as possible. This is unlikely to happen unless there is a problem with the property i.e. electricity, water or gas supply, leaks etc.. The Company will make every endeavour to inform the Client of any change of property and wherever possible will send details of the alternative accommodation to the Client.
  9. Cancellation by the Client:   Clients are advised to take out insurance against loss of holiday moneys through unforeseen cancellation. If written notice of cancellation of the booking is received by the Company more than ten weeks before the arrival date, the Client will be offered the option to transfer the deposit to a different date, and or different venue.  Should this not be acceptable to the Client, 25% of their deposit will be returned. If the cost of rental at the alternative venue is more expensive, the Client shall pay the shortfall to ensure a deposit of 20% of the cost of rental has been paid. Except with the written agreement of the Company the alternative date must be within 6 months of the initial arrival date for the holiday. No further cancellation or rearrangement will be agreed to once a second fixed date for the holiday has been agreed. The deposit is forfeit should there be a request for variation of date and venue or a further outright cancellation.
    If notice of cancellation of the booking is received between six and ten weeks before arrival the client will receive 25% of the deposit from the Company.  
    If the booking is cancelled within six weeks of arrival the Company will not refund any part of the moneys paid.
  10. On Departure: The Client will be required to vacate the property by 12.00 noon on the day of departure.   The Client is required to treat the property and contents with care and consideration , and leave the property in a good condition.  The Client is asked to report any damage or faults in the property to the Company in order for these to be rectified before the next Client arrives.
  11. Force Majeure:  Circumstances amounting to “force majeure” which include war, terrorist activity, natural or nuclear disaster, may necessitate cancellation of the booking by the Company. Should we be required to cancel, delay, curtail or in any way change your holiday; under these circumstances the Company cannot be held responsible.
  12. Services:  Power cuts and water shortages may happen during the course of a booking.  The Company cannot be held responsible for these events but will do everything to help, should this happen.
  13. Cleaning:  The price of the Client´s holiday includes cleaning before arrival, clean linen and bathroom towels supplied, beds made up and a basic grocery pack installed, including bread, water, butter/spread, jam or marmalade, tea, coffee, sugar and the normal household goods including washing up liquid, washing powder. The cleaning and laundry of the property when the Client leaves is also included. There will be an additional charge should the Client wish to have cleaning and/or laundry dealt with during occupancy.
  14. Extras: A number of additional services and items for hire may be offered by the Company. These items may include golf clubs, hairdryers, travel cots and bedding. Beach Towels can also be supplied at a set cost.  These extras will be supplied by the Company.  Golf Clubs can be hired for €25 for one day, €40 for two days, €50 for three days and €10 per day thereafter, Travel Cots €10 per week, Hairdryers €5 a week, Beach Towels €5 per week each. This list is not exhaustive and may vary from time to time.
  15. Dietary Requirements: A welcome pack of food is included in the rental of the property. Should a prospective Client have specific dietary needs and require special foodstuffs, please request this on booking. Please inform the Company of any special requirement; reasonable efforts will be made to accommodate for these.
  16. Swimming Pools:  Where an individual property has a swimming pool, the Client must accept total responsibility for safety of all members of the party.
  17. Ongoing Maintenance and Repairs:  Items within a property do malfunction occasionally.   Should this happen, the Client should report this to the Company and we will do everything possible in order to deal with a problem as quickly as possible.
  18. Liability:  The Owners of the properties are liable in respect of death, bodily injury or illness arising as a direct result of the negligent acts or omissions of the Owners in respect of the property.  Should a claim arise, all Owners are required to have Public Liability cover within their property insurance. Thus Owners and Clients are required to accept the jurisdiction of Spanish Law and Courts.
  19. Copyright: Content and software on this website is copyright protected. Other than personal use, content may not be otherwise used or copied without prior written consent by the Company.
  20. Cable or Satellite TV:  Where a property has Cable or Satellite TV, the Company shall endeavour to ensure that service is provided.  However, should service be suspended by the outside server, the Company cannot be held responsible for this.
  21. Liability for service provided: The Company accepts responsibility for ensuring that the property is provided clean and as described on the Website.  The Company does not accept liability for any disappointment which the Client may feel as a result of unrealistic expectations.
